Terms of Service

1. Acceptance of terms

By creating an account or using the VertexData service ("Service") available at www.rencarndata.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and VertexData ("we", "us", "our").

2. Description of service

VertexData provides a cloud storage service that allows you to upload, store, manage, and access files via a web interface or WebDAV protocol. The Service includes:

  • Secure file storage on servers hosted in the European Union
  • File preview for supported formats (images, video, audio, PDF)
  • WebDAV drive mounting for desktop integration
  • Subscription-based storage plans (Free, Personal, Power) and an optional Streaming add-on
  • Native iOS and Apple TV application (VertexData) available on the Apple App Store

3. Account registration

To use the Service you must:

  • Be at least 16 years of age (or the age of digital consent in your country)
  • Provide a valid email address and a password of at least 8 characters
  • Keep your credentials confidential — you are responsible for all activity under your account
  • Notify us immediately at contact@codeandcraft3d.com if you suspect unauthorised access

One account per person. You may not create accounts on behalf of others without their consent.

4. Acceptable use

You may use the Service only for lawful purposes. You must not upload, store, or transmit:

  • Content that is illegal under EU law or the laws of your country
  • Child sexual abuse material (CSAM) — violations will be reported to authorities immediately
  • Malware, ransomware, or any malicious software
  • Content that infringes third-party intellectual property rights
  • Content used to harass, threaten, or harm others

We reserve the right to suspend or terminate accounts that violate these rules without notice. We do not proactively scan file contents, but we will act on valid reports.

5. Storage plans and billing

The Service is offered on a subscription basis. Plan details (storage quota, price, interval) are displayed on the Account page and at checkout.

  • Free plan: 5 GB storage at no charge, no credit card required.
  • Personal plan: 100 GB storage, billed monthly (€12.99) or yearly (€129.99) in EUR via Stripe (web) or Apple App Store (iOS/Apple TV).
  • Power plan: 500 GB storage, billed monthly (€29.99) or yearly (€289.99) in EUR via Stripe (web) or Apple App Store (iOS/Apple TV).
  • Streaming add-on: €14.99/mo — includes Pro Player capabilities; stream your VertexData files and connect to Plex, Jellyfin, Emby and NAS on iOS and Apple TV. Can be added to any paid plan.
  • Renewals: Subscriptions renew automatically at the end of each billing period unless cancelled beforehand (see Section 5a for Apple subscriptions).
  • Cancellation (web): You may cancel at any time via the "Manage subscription" button. Access continues until the end of the current paid period; no partial refunds are issued for unused time.
  • Upgrades/Downgrades: Plan changes take effect immediately; Stripe calculates any prorated adjustments for web billing.
  • Failed payments: If a renewal payment fails, we will retry and notify you by email. Continued failure may result in downgrade to the Free plan.

EU Consumer Right of Withdrawal: Under EU Directive 2011/83/EU, you have a 14-day right of withdrawal from the date of your first subscription payment. To exercise this right, email contact@codeandcraft3d.com within 14 days. Note: by accessing the paid features immediately you expressly request early performance and acknowledge this may affect your withdrawal right.

5a. In-app purchases (iOS and Apple TV)

Subscriptions purchased through the VertexData iOS or Apple TV app are processed by Apple and subject to Apple's payment terms.

  • Apple subscriptions renew automatically unless cancelled at least 24 hours before the renewal date
  • To cancel an Apple subscription, go to iOS Settings → Apple ID → Subscriptions
  • Apple subscriptions cannot be managed or cancelled through the VertexData website
  • Refunds for Apple purchases must be requested directly from Apple at reportaproblem.apple.com
  • Price changes will be notified by Apple at least 30 days in advance
  • The EU 14-day right of withdrawal applies to Apple subscriptions subject to Apple's terms

6. File upload limits

  • Maximum file size: 5 GB per file
  • Accepted types: Images, video, audio, documents (PDF, DOC, TXT), code files, archives (ZIP, RAR, TAR, GZ), and disk images (ISO, DMG)
  • Storage quota: Uploading beyond your plan quota is not permitted. You will receive a warning when approaching your limit.

7. Your content and our licence

You retain full ownership of all files you upload ("Your Content"). By using the Service, you grantVertexData a limited, non-exclusive, royalty-free licence to store, copy, and transmit Your Content solely for the purpose of providing the Service to you.

We do not claim any ownership over Your Content, and we do not access, analyse, or use it for any purpose other than operating the Service.

8. Data protection

We process your personal data in accordance with our Privacy Policy and applicable EU data protection law (GDPR). By using the Service you acknowledge that you have read and understood the Privacy Policy.

9. Service availability and SLA

We aim to maintain 99.5% uptime but do not guarantee uninterrupted availability. Scheduled maintenance will be announced at least 24 hours in advance where possible. We are not liable for losses caused by temporary unavailability.

Backups: We store your files in AWS S3 with server-side redundancy, but VertexData is not a backup service. You are responsible for maintaining copies of critical data.

10. Limitation of liability

To the fullest extent permitted by EU law, VertexData's total liability to you for any claim arising from use of the Service is limited to the amount you paid us in the 3 months preceding the claim.

We are not liable for: indirect or consequential losses, loss of data (see Section 9), loss of revenue or profits, or losses arising from third-party service failures (Stripe, AWS, Supabase).

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Termination

By you: You may delete your account at any time from the Account page. This permanently deletes all your files and data within 30 days.

By us: We may suspend or terminate your account immediately if you breach these Terms, or with 30 days' notice for any other reason. In the event of termination without cause, we will refund the unused portion of any prepaid subscription.

12. Account deletion and data

You may delete your account at any time from Account Settings → Danger zone.

  • All your files will be permanently removed from our servers upon deletion.
  • Your account and login credentials will be immediately deactivated.
  • Any active subscription will be cancelled immediately upon account deletion.
  • No refunds are provided for unused subscription periods (except where required by the EU 14-day right of withdrawal — see Section 5).
  • Billing records are retained for 7 years as required by EU tax law, even after account deletion. All other personal data is erased immediately.

13. Changes to the service or terms

We may modify the Service or these Terms at any time. For material changes, we will give at least 30 days' notice by email. Continued use after the effective date constitutes acceptance of the updated Terms. If you do not agree with changes, you may cancel your subscription and delete your account.

14. Governing law and disputes

These Terms are governed by EU law. Any dispute that cannot be resolved informally shall be subject to the jurisdiction of the competent courts of the EU member state in which you reside, or the courts of our principal place of business, at your option.

For disputes arising from iOS or Apple TV app purchases, Apple's standard EULA terms also apply and are incorporated by reference.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
